Federal law requires clear disclosure on all sponsored content, and multiple states have their own attorney-advertising rules. These requirements are non-negotiable — and they protect you as much as they protect us.

Disclosure Placement — Read This First

  • #ad in the FIRST LINE of every caption. Before your text, before the "see more" truncation.
  • Video: on-screen + spoken in the first 3 seconds. Caption-only is not enough.
  • Platform "Paid Partnership" tags alone are not sufficient. The FTC has found these easy to miss when used alone — you still need #ad in the caption and, for video, in-frame.
  • Both you and Sweet James are liable if disclosure is missing or buried — even if your agreement says otherwise. Under the FTC Endorsement Guides (16 CFR Part 255), any material connection (payment, free product or services, commission, or ambassador status) must be disclosed in the endorsement itself, not just in a legal disclaimer.

Caption Format — Correct Order

Every paid post caption must follow this exact order. Do not rearrange — placement is what makes disclosure "clear and conspicuous" under FTC rules, and Instagram/TikTok truncate captions after 2–3 lines.
